Real Estate broker is the term used in the United States of America and Canada to refer to a person or organization whose business is to do marketing for a real estate on behalf of clients. A real estate agent is a term used in the United kingdom for the person who acts as a third party between the sellers and the buyers of a real estate (or real property as some may refer to it) and he also attempts to find sellers who wish to sell and buyers who wish to buy real estate/property.
Usually the term agent and broker are used synonymously however in actuality there are significant differences between the actions and liabilities of the real estate brokers and the real estate agents which may vary from country to country. Apart from US, other countries take quite different approaches to the marketing and selling of real property hence different chores exist for both the broker and the agents.
If you are interested in becoming a real estate broker you are required to take a minimum number of classes (of between 40 and 90 hours) before taking the state licensing exam. Usually this kind of education is given by the real estate brokerages as a means to finding new agents. In a way this is good because in order to know the practical side of the business the salespersons should be associated with and act under the authority of a real estate broker. Only a licensed real estate broker is a professional person who has obtained either a real estate salesperson's license or a real estate broker's license and only these licensed persons should be contacted when buying or selling stuff. Usually the broker provides a conventional full-service which is commission-based brokerage relationship followed by a signed listing agreement with a seller or "buyer representation" agreement with a buyer. This is said to be creating an agency relationship with fiduciary obligations under common law in most states. The seller or buyer after signing such an agreement becomes client of the broker. In a Non-agency relationship neither written agreement nor any fiduciary relationship exists. The real estate broker works with a person who is then referred as the broker’s customer. If a buyer who has not signed any sort of agreement buys a property, the broker and his agents act as the sub-agent of the seller’s broker. Similarly when a seller decides to work with a transaction broker and has not signed any agreement there is no agency relationship created.
